The rule, and where it comes from

  • No gratuity is due before one year of continuous service. After it, the gratuity is 21 days' basic wage for each of the first five years and 30 days' basic wage for each year after them (Article 51).
  • Part of a year counts in proportion, once the first year is complete. Days of absence without pay do not count as service.
  • The base is the last basic wage: housing, transport and other allowances are left out.
  • A day's wage is the monthly basic wage divided by 30, and a year of service is 365 days: Article 67 counts every period in the law on the Gregorian calendar, a year as 365 days and a month as 30.
  • The total may not exceed two years' wage. The law does not say whether that means 24 monthly wages or 730 days' wages; past about 25 years of service the two differ, and the calculator shows both.
  • Not covered: UAE nationals, whose end-of-service benefit follows the pensions law; part-time and other work patterns (Article 30 of Cabinet Resolution No. 1 of 2022); workers enrolled in the voluntary savings scheme; amounts the employer may lawfully deduct.

How is end-of-service gratuity calculated in the UAE?
Under Article 51 of Federal Decree-Law No. 33 of 2021, a full-time foreign worker with at least one year of continuous service receives 21 days' basic wage for each of the first five years and 30 days' basic wage for each year after that, with part years in proportion. The total is capped at two years' wage.
Is the gratuity based on the basic salary or the full salary?
On the last basic wage. Allowances such as housing, transport, utilities and furniture are not included.
Do I get a gratuity if I worked less than a year?
No. The gratuity is due only after one year of continuous service. After that first year, part years count in proportion.
How is one day's wage worked out?
As the monthly basic wage divided by 30. Article 67 of the decree-law counts a month as 30 days and a year as 365 days for every period in the law.
